As voter suppression laws spread across the country, voting rights advocates can take heart: the biggest state in the nation is on the cusp of passing a major voter protection initiative.

Election Day Registration (EDR), which allows citizens to register up to and on Election Day, passed the California State Senate today by a party-line vote of 23-13. AB 1436 had passed the State Assembly in May 47-26.

Under current law, Californians cannot register to vote in the final two weeks before an election, just as many Americans are beginning to tune in. EDR will eliminate that deadline, ensuring that no citizen is disenfranchised because he or she wasn’t registered beforehand.

This won’t just benefit slackers. Historically-disenfranchised citizens like minorities and poorer Americans, will particularly benefit from EDR. On average, studies have found that EDR boosts voter turnout by seven percentage points. Common Cause’s Phillip Ung told ThinkProgress he “expects voter turnout to increase by the hundreds of thousands” solely as a result of EDR.

Eight states currently allow their citizens to register on Election Day: Idaho, Iowa, Maine, Minnesota, Montana, New Hampshire, Wisconsin, and Wyoming. California is poised to become the latest, and by far the largest, state to enact EDR.

California’s version of EDR differs slightly from the way it’s employed elsewhere. Rather than allowing citizens to register at regular polling stations, as they do in Maine, for instance, California will have Election Day registration at a county registrar’s office, where citizens will be able to vote as well.

The bill now returns to the Assembly for a concurrence vote — which is all but assured of passage — due to a small change in the Senate version before reaching Gov. Jerry Brown’s (D) desk. Brown has not commented publicly on the bill, but has been very supportive of election reform efforts in the past and advocates expect he will sign the legislation.

AB 1436 also increases the fine for voter fraud to $50,000, one of the highest penalties in the country.

Assuming Brown signs the bill, it will not take effect until the next presidential election in 2016.

Floridians line up to vote.

Former Florida Gov. Charlie Crist recently wrote an op-ed condemning “zealots” for imposing new restrictions on voting, “overreacting to contrived threats of voter fraud by significantly narrowing the voting pool.” As it turns out, he’s not the only former Florida Republican with these concerns.

In a 630-page deposition recorded over two days in late May, [Florida's former Republican Party chairman Jim Greer], who is on trial for corruption charges, unloaded a litany of charges against the “whack-a-do, right-wing crazies” in his party, including the effort to suppress the black vote.

In the deposition, released to the press [last week], Greer mentioned a December 2009 meeting with party officials. “I was upset because the political consultants and staff were talking about voter suppression and keeping blacks from voting,” he said, according to the Tampa Bay Times. He also said party officials discussed how “minority outreach programs were not fit for the Republican Party,” according to the AP.

In fairness, it’s not unreasonable to question Greer’s veracity. The man is facing felony corruption charges and very likely carries a grudge against his former colleagues — the state GOP quickly kicked him to the curb when his legal troubles began.

But if Greer’s deposition is accurate, and he saw first-hand that Republican officials took specific, deliberate steps to disenfranchise African-American voters, this not only sheds new light on Gov. Rick Scott’s (R) “purge” crusade, it also confirms the worst Democratic fears about the ugly motivations behind the Republican Party’s “war on voting.”

In the meantime, controversy continues to plague Pennsylvania’s voter-ID law, and one elections official said last week he’ll refuse to enforce it.

“To ask me to enforce something that violates civil rights is ludicrous and absolutely something I am not willing to do,” [Christopher Broach, a Democratic inspector of elections in Colwyn, Pa.] told the Philadelphia Inquirer.

Though there’s the potential he could face fines or prison Broach said his mind is made up.

“Rosa Parks made the same decision,” he told the paper.

I’m not sure if the Rosa Parks comparison is quite right, but if other local election officials in Pennsylvania reject the scandal-plagued law, it’s a development well worth watching.

Suppose Mitt Romney ekes out a victory in November by a margin smaller than the number of young and minority voters who couldn’t cast ballots because the photo-identification laws enacted by Republican governors and legislators kept them from the polls. What should Democrats do then? What would Republicans do? And how would other nations respond?

As suppositions go, this one isn’t actually far-fetched. No one in the Romney camp expects a blowout; if he does prevail, every poll suggests it will be by the skin of his teeth. Numerous states under Republican control have passed strict voter identification laws. Pennsylvania, Texas, Indiana, Kansas, Tennessee and Georgia require specific kinds of ID; the laws in Michigan, Florida, South Dakota, Idaho and Louisiana are only slightly more flexible. Wisconsin’s law was struck down by a state court.

Instances of voter fraud are almost nonexistent, but the right-wing media’s harping on the issue has given Republican politicians cover to push these laws through statehouse after statehouse. The laws’ intent, however, is entirely political: By creating restrictions that disproportionately impact minorities, they’re supposed to bolster Republican prospects. Ticking off Republican achievements in Pennsylvania’s House of Representatives, their legislative leader, Mike Turzai, extolled in a talk last month that “voter ID . . . is going to allow Governor Romney to win the state of Pennsylvania.”

How could Turzai be so sure? The Pennsylvania Department of State acknowledges that as many as 759,000 residents lack the proper ID. That’s 9.2 percent of registered voters, but the figure rises to 18 percent in heavily black Philadelphia. The law also requires that the photo IDs have expiration dates, which many student IDs do not.

The pattern is similar in every state that has enacted these restrictions. Attorney General Eric Holder has said that 8 percent of whites in Texas lack the kind of identification required by that state’s law; the percentage among blacks is three times that. The Justice Department has filed suit against Southern states whose election procedures are covered by the 1965 Voting Rights Act. It is also investigating Pennsylvania’s law, though that state is not subject to some provisions of the Voting Rights Act.

If voter suppression goes forward and Romney narrowly prevails, consider the consequences. An overwhelmingly and increasingly white Republican Party, based in the South, will owe its power to discrimination against black and Latino voters, much like the old segregationist Dixiecrats. It’s not that Republicans haven’t run voter suppression operations before, but they’ve been under-the-table dirty tricks, such as calling minority voters with misinformation about polling-place locations and hours. By contrast, this year’s suppression would be the intended outcome of laws that Republicans publicly supported, just as the denial of the franchise to Southern blacks before 1965 was the intended result of laws such as poll taxes. More ominous still, by further estranging minority voters, even as minorities constitute a steadily larger share of the electorate, Republicans will be putting themselves in a position where they increasingly rely on only white voters and where their only path to victory will be the continued suppression of minority votes. A cycle more vicious is hard to imagine.

It’s also not a cycle calculated to endear America to the rest of the world. The United States abolished electoral apartheid in the 1960s for reasons that were largely moral but were also geopolitical. Eliminating segregation and race-specific voting helped our case against the Soviets during the Cold War, particularly among the emerging nations of Asia and Africa. It’s not likely that many, anywhere, would favorably view what is essentially a racially based restriction of the franchise. China might well argue that our commitment to democracy is a sham.

And what should Democrats do if Romney comes to power on the strength of racially suppressed votes? Such an outcome and such a presidency, I’d hope they contend, would be illegitimate — a betrayal of our laws and traditions, of our very essence as a democratic republic. Mass demonstrations would be in order. So would a congressional refusal to confirm any of Romney’s appointments. A presidency premised on a racist restriction of the franchise creates a political and constitutional crisis, and responding to it with resigned acceptance or inaction would negate America’s hard-won commitment to democracy and equality.

The course on which Republicans have embarked isn’t politics as usual. We don’t rig elections by race in America, not anymore, and anyone who does should not be rewarded with uncontested power.

Are too many Democratic voters sleepwalking away from our democracy this election cycle, not nearly outraged enough about Big Money’s undue influence and Republican state legislatures changing the voting rules?

It seems so.

A Gallup poll released this week found that: “Democrats are significantly less likely now (39 percent) than they were in the summers of 2004 and 2008 to say they are ‘more enthusiastic about voting than usual’ in the coming presidential election.” Republicans are more enthusiastic than they were before the last election.

Some of that may be the effect of having a Democratic president in office; it’s sometimes easier to marshal anger against an incumbent than excitement for him. Whatever the reason, this lack of enthusiasm at this critical juncture in the election is disturbing for Democrats.

First, there’s the specter of the oligarchy lingering over this election, which disproportionately benefits Republicans. According to a report by Senator Bernard Sanders of Vermont, “So far this year, 26 billionaires have donated more than $61 million to super PACs, according to the Center for Responsive Politics. And that’s only what has been publicly disclosed.” That didn’t include “about $100 million that Sheldon Adelson has said that he is willing to spend to defeat President Obama; or the $400 million that the Koch brothers have pledged to spend during the 2012 election season.”

During a Senate Judiciary subcommittee hearing on Tuesday, Sanders put it this way: “What the Supreme Court did in Citizens United is to say to these same billionaires and the corporations they control: ‘You own and control the economy; you own Wall Street; you own the coal companies; you own the oil companies. Now, for a very small percentage of your wealth, we’re going to give you the opportunity to own the United States government.’ ”

Then, of course, there’s the widespread voter suppression mostly enacted by Republican-led legislatures.

According to the Brennan Center for Justice at the New York University School of Law, at least 180 restrictive voting bills were introduced since the beginning of 2011 in 41 states, and “16 states have passed restrictive voting laws that have the potential to impact the 2012 election” because they “account for 214 electoral votes, or nearly 79 percent of the total needed to win the presidency.”

A provision most likely to disenfranchise voters is a requirement that people show photo identification to vote. Millions of Americans don’t have these forms of ID, and many can’t easily obtain them, even when states say they’ll offer them free, because getting the documentation to obtain the “free” ID takes time and money.

This is a solution in search of a problem. The in-person voter ID requirements only prevent someone from impersonating another voter at the polls, an occurrence that the Brennan Center points out is “more rare than being struck by lightning.”

The voting rights advocates I’ve talked to don’t resist all ID requirements (though they don’t say they are all necessary, either). They simply say that multiple forms of identification like student ID and Social Security cards should also be accepted, and that alternate ways for people without IDs to vote should be included. Many of these laws don’t allow for such flexibility.

Make no mistake about it, these requirements are not about the integrity of the vote but rather the disenfranchisement of voters. This is about tilting the table so that more of the marbles roll to the Republican corner.

Look at it this way: We have been moving toward wider voter participation for a century. States began to issue driver’s licenses more than a century ago and began to include photos on those licenses decades ago. Yet, as the Brennan Center points out, “prior to the 2006 election, no state required its voters to show government-issued photo ID at the polls (or elsewhere) in order to vote.”

Furthermore, most voter laws have emerged in the last two years. What is the difference between previous decades and today? The election of Barack Obama. It is no coincidence that some of the people least likely to have proper IDs to vote are the ones that generally vote Democratic and were strong supporters of Obama last election: young people, the poor and minorities.

Republicans are leveraging the deep pockets of anti-Obama billionaires and sinister voter suppression tactics that harken back to Jim Crow to wrest power from the hands of docile Democrats.

There is little likely to be done about the Big Money before the election, and, although some of the voter suppression laws are being challenged in court, the outcome of those cases is uncertain.

These elements are not within voters’ control, but two things are: energy and alertness.

If Democrats don’t wake up soon, this election might not just be won or lost, it could be bought or stolen.
